@Angle I feel like those are two separate questions. The first is about the choice and the harm it does and to whom. The second is about feasibility of enacting this law and whether it will harm ability to pass other laws?
That is, 'what laws should exist, ideally' is related to but kind of independent from 'how do we rank laws in importance so we pass the most most important laws?'

But as to your original question I think there's some combination of:
How badly will it hurt others and how likely is that to happen? Are there ways it can be done WITHOUT hurting others and it's just a risk of screwing up?
When it hurts oneself, is it because it is a thing many people think WON'T hurt them or won't be as likely to hurt them as it is, but there's a systematic bias?
